3.When Should Trademark Searches Be Conducted?

A. For Domestic Businesses

We frequently see businesses approach us after:

  • incorporating a company,
  • obtaining GST registration,
  • investing in branding and packaging,
  • finalising logos and marketing material,

only to discover that the proposed trademark is unavailable or commercially risky.

At that stage, changing the brand often becomes significantly more expensive and disruptive.

Trademark clearance searches should ideally be conducted before substantial commercial adoption and investment in the mark.

B.For International Applicants Under the Madrid Protocol

For foreign brand owners designating India under the Madrid Protocol, pre-filing clearance searches become even more important. This is particularly relevant in multi-class international registrations designating India.

Madrid designations can create procedural and strategic complications if conflicts arise in relation to specific goods or services, given that the Indian TMO does not permit division of classes in international applications filed designating India.

A pre-designation search can help identify conflict risks, problematic specifications, class-related vulnerabilities, prosecution risks, and possible evaluation of filing a National Application in India.

4. What Happens After a Trademark Search?

Based on search results, businesses can assess:

  • whether to file for a word mark, logo, or both
  • whether modifications should be made to strengthen the mark
  • appropriate class coverage
  • specification refinement and
  • broader brand protection strategy.

In many cases, relatively small adjustments at the outset can materially improve registrability and long-term enforceability.
