Patents, Plant Varieties and Designs

R. Sakthiya Dakshi is a registered Patent Agent and an Advocate enrolled with the Bar Council of Delhi, with over a decade of experience in patent law and allied areas of intellectual property. Her practice covers end-to-end advisory, prosecution, and portfolio management across patents, as well as copyrights, and designs. She is also empanelled as a Facilitator under the Start-ups Intellectual Property Protection (SIPP) Scheme with the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM).
She works with a broad spectrum of clients, including individual innovators, academic and research institutions, incubation centres, start-ups, SMEs, and multinational companies, advising them on protection and commercialisation of intellectual property.
Her core focus lies in patent drafting and prosecution, particularly in technically intensive domains such as biotechnology, nanotechnology, life sciences, chemical sciences, and industrial engineering. She regularly undertakes prior art searches, prepares detailed patent specifications, and advises on issues relating to patentability, infringement, and validity.
Sakthiya represents clients before the Indian Patent Office across all stages of patent prosecution, including examination responses, claim amendments, and recordal of assignments. She also handles contentious proceedings such as pre-grant and post-grant oppositions, including drafting of petitions, evidence, and interlocutory filings. She has been involved in filing and prosecuting numerous patent applications before the Indian Patent Office, as well as coordinating filings with the USPTO and WIPO, and has contributed to validation of inventions across multiple sectors.
Beyond prosecution, she advises on structuring and documenting IP transactions, including licensing, assignments, co-development, and collaboration arrangements. Her experience includes drafting and reviewing agreements relating to technology transfer, IP licensing, software services, and other commercial arrangements.
She has also supported farming communities in securing Plant Variety Protection for new seed varieties.

She is also regularly invited to deliver lectures and training sessions on intellectual property at universities and incubation centres across India.
